The Vesting of Ownership to the Occupants Act, 2001 (Roshni Act) aimed to confer ownership rights over 20.55 lakh kanals of land to occupants, but only 15.85% of the land received approval. The Jammu and Kashmir High Court declared it unconstitutional in 2020, and it was repealed by Governor Satya Pal Malik in November 2018. A new bill proposed by PDP leader Parra seeks to grant ownership rights to residents living on state land, kahcharai land, common land, and shamilat land, addressing the issue of illegal constructions. The bill suggests these rights be given to residents with a valid permanent resident certificate (PRC) who have occupied the land for over 20 years. It excludes commercial buildings and allows for a one-time regularization fee, capped at one-third of the circular rate. Special exemptions are proposed for disadvantaged groups, including those below the poverty line or with disabilities. However, no regularization will be allowed for constructions after March 1, 2025, or on restricted lands.
