A local court has dismissed a police challan against PDP leader Waheed Parra for allegedly violating the Model Code of Conduct (MCC) during an April 2024 rally, citing procedural lapses in the complaint.
Additional Special Mobile Magistrate Muneer Ahmad Bhat ruled that Section 188 IPC (disobedience of public orders) couldn’t apply as the MCC lacks statutory backing and no competent authority—like the Election Commission—filed the mandatory complaint under CrPC Section 195.
The court ordered Parra’s release and return of seized materials. The judgment emphasized that the MCC serves as guidance, not legally enforceable orders, and noted the prosecution’s failure to identify which public servant’s directive was violated. (Kashmir Life)
